Proposed Changes to California’s Equality Laws (ACA 7) – Survey #17

My name is Long Jiao, and as a member of the Cupertino Union School District (CUSD) Board of Education, I am dedicated to building stronger connections with our community through transparent communication and feedback opportunities. These independent surveys help me stay informed on your priorities and ensure diverse voices guide our work. Please note: This survey is conducted solely by me and does not represent the official position of the full CUSD Board.

I am reaching out to invite your feedback on a significant legislative development in Sacramento that could directly impact our schools: Assembly Constitutional Amendment 7 (ACA 7).

The Context: Since 1996, the California Constitution (via Proposition 209) has prohibited school districts and government agencies from using race, gender, or ethnicity as a factor in admissions, hiring, or program placement. While voters reaffirmed this “equal treatment” principle by defeating Proposition 16 in 2020, a new measure, ACA 7, is currently moving through the State Senate.

The Proposed Change: Unlike previous versions, ACA 7 now proposes to delete “public education” (K-12) from the list of areas where racial and gender preferences are prohibited. While it keeps a ban for college admissions to comply with the Supreme Court, it leaves K-12 schools unprotected by the current “equal treatment” mandate. This would allow districts to use race or ethnicity as a factor in student placement, program enrollment, and resource allocation.

Your Voice Matters: I am conducting this independent survey to ensure that our community’s priorities are heard. I plan to share the anonymized results with the State Senators who represent the CUSD area—Josh Becker, Dave Cortese, and Aisha Wahab—before they take a final vote on this measure.
